Framingham is ready for pot shop applicants... sort of

At last nights CC meeting towards the end when the COO spoke about the process of taking applications for pot shops. The more I watch him talk in circles the more I miss Town Meeting. At 2:28:00 the chairman actually says he's "frustrated" saying the city is somewhat stalling in not getting the application portal up. It's humorous to hear the Chairman frustrated with the delays all along knowing he alone has produced, choreographed and stared in the year long delay play for 2018. He did admit to visiting the Medical Marijuana store on Rte 30. Which makes me chuckle to see that after his years of attempts at blocking the RMD and 6 years after it was passed by the voters, he finally made a tour of the facility. And then comes a memo from the Mayor last night telling us that another group of prohibitionists (MAT Marijuana Advisory Team) will advise the Mayor on the applicants. The BOH regs incorporate all of the State regs plus their own reefer madness. Any retail store will have to pay 2k for a permit from the BOH. Leaving no stone under turned on page 15: 15:00 Effective date is January 8, 2014.

the chairman actually says he's "frustrated" saying the city is somewhat stalling. Giombetti has got some pretty big hypocritical balls to make such a quote. This is why people hate politicians!

Exactly correct.. that's why I despise their version of democracy.

I did expect something different. It's been vetted over and over and over again. What's left to figure out? As of today, the web portal is still not available for applications. The administration makes more trouble for themselves than need be.

Yeah.. Dennis was pleased to tell me on Veterans Day he toured the Temascal facility. Good thing Steph was with me or I would've jumped on him. He's just a hypocritical, power gone mad, egocentric Bob DeLeo want to be.

Jim -- you're problem is that you dont have their reality changing machine. I've always wondered whether they think they are just fooling us with their new version of reality they have made up, or if they actually convince themselves that their new version is what really did happen.

Sad to see that Framingham BOH is once again allowed to have more power than they should. Do other communities have boards of health that impose additional charges? BUt I have to say, an additional $2000 fee is nothing when you consider what their host agreements will cost them

And to further your point about their reality, we have2 maybe three media sources covering the meetings and not one has written about any of this. None of them want to challenge anything the Council does.

I'm only aware of Arlington BOH who has raised the age limit to 25. I'm not aware of any other community that the BOH has overreached their jurisdiction like here in Framingham in the name of public health.
I agree.. the host agreement is way over the top when considering no other business would ever agree to pay a tax of 3% of their sales to a community. It's just plain extortion of small businesses by those who have been given the power to do so legally.

This was all a result of that first dispensary that agreed to give money to the community they were opening in. If they had all refused they would not be in this position. Shame on them

Do they really have that power officially Jim, or do they just take it and since no one challenges them they get away with it. What power does the state give to municipal BOH? Seems to me I remember a question about this coming up in the past at an actual BOH meeting when someone from the state came in to review their authority with them but I could be wrong.

True on the medical guys... they almost had to offer huge money to get permission to set up shop, which was voluntary. Those first guys knew how big the money would be in Medical. In other States it was making millionaires out of local people. But the RMD guys have to pay up to 3% in the host agreement, it's in the State regs that were changed by the Dirty Dozen on Beach Hill.

The BOH power is granted by Mass General Laws Chapter 111, section 31 says "Boards of Health may make reasonable health regulations". How they got to be in this to begin with starts with the Dirty Dozen on Beacon Hill and the MMA (Mass Municipal Assoc) and then our own BOS who in late 2016 decided to punt to the new city council and Mayor. Giombetti made sure the BOH was involved with the Marijuana Task Force which allowed the BOH to get involved to begin with.
I did see a BOH meeting that someone from another BOH cited court case examples of how any BOH can step in if they (BOH) believe that a public health problem could occur. As I remember the meeting.
