A tie after the recount in D3

Have a look at the bank totals for all the races. A fair amount of voters in various districts didn't like the choices and decided to not register their vote for any candidate.

The Patch reported that the city council can appoint someone temporarily until an election or a judge rules in favor of one over another.

or

 It could go to superior court and have a judge decide what the intentions of those two voters was

 or

 A special election.

 A spokesperson for the Secretary of the Commonwealth said Tuesday that it's possible the City Charter's provision on vacancies could apply. Under the charter, the candidate with the next-highest number of votes fills any vacancy in a district Council seat. Absent that — such as in the case of a deadlocked recount — the City Council gets to fill the seat.

"Whenever a vacancy shall occur ... in that of district councilor and there is no available candidate to fill the vacancy in the manner provided ... the vacancy shall be filled by vote of the remaining members of the council. Notice of said councilor vacancy shall be posted for a minimum of twenty-one (21) days prior to the meeting at which the council shall fill any such vacancy," the charter says.

Now what happens Jim? They have the court date, but they also set a date for a special election. Can they just ignore the court's decision if it does not go the way they want it to?

So the Judge in Superior court has the ballots in question.. all of 2. He will render a decision on Monday hopefully.
If the ballots are rejected by the judge for MKF, then it will be a tie and an election will be the 28th of December.
I believe that the new precinct/district lines the State legislature approved with not be in effect then. So.. the same voters that voted in Nov, will be the same who vote in December.

The election will be Jan 11 using the old district map lines.
