BOH dismisses a tobacco violation

The attorney for Big Town Pantry successively defended his clients and had shown that the evidence presented at 2 BOH meetings was proven without a doubt to be absolutely false. The complaint stems for a sting operation, sending a teenager in to buy cigs. The BOH presented and the adult supervisor contend that the sale was done on that date, time and place, but the evidence doesn't support any of the claims, (written reports) the adult supervisor gave or the teenager. As you will see, every part of the sale is questioned, from the appearance of the clerks to how much they paid for the cigs. All of which was captured on camera, but they only save the recordings so long. No one from the BOH contacted the store owner to ask them to save that video from that day. This event does show that the BOH needs to do a better job in evidence collecting and be sure of their facts before they take a license away from a business owner.

Why is this such a big issue for the BOH? What are they doing about opioids, fentanaly and heroin on our streets? What about the drunks downtown? Seems they are going after low hanging fruit and messing even that up

This will give every single store that receives a notice of a violation grounds for appeal going forward. If these stings are not managed and are not valid then shame on the BOH. They facts seem clear here so why did the BOH continue to support the findings that clearly had serious issues? Sounds like they work like the state police. The importance is in the number of charges you make, whether they are true or not. Shame on our BOH

Looks like the BOH has egg on their face on this one. So what happens now with these sting operations? It looks like this was a made up issue, so how do we know this does not happen again or even has happened already in the past?

Who oversees this, the BOH or the police? Or do they just some kid off on his own and take his word for what they find?

The program of compliance checks goes back many years and was first done by the Fed's I believe I heard the elder adult supervisor say. No one oversees the BOH as far as I know, except perhaps the Mayor and I'm very sure she dosen't watch any of their meetings on demand.
It is interesting to see the lack of response from the Council members. I guess they don't don't care about the lack of credibility at the BOH. I'm writing Cannon.

Everyone has to answer to someone. We should all reach out to the board of health to voice our concerns about this obviously made up scam on this store

but your complaining to Sam Wong... and he brought this forward, knowing from the last meeting when their lawyer questioned the evidence the facts didn't line up..

I think our BOH has an ego too big to fit inside the City Hall. They have been allowed to do things beyond the normal scope of their pervue for so long they think they can do anything they want at this point and unless the Mayor holds them accountable for this obvious huge mess then they will continue to do just that. Skip writing to the BOH. I say we all call the Mayor to express our concern

I read the Letter to the editor in Source today about other issues that came up at this BOH meeting. Seems that they don't listen to the will of the people they represent, they just act as if we are all dumb and they are smarter than all of us. I think they are all arrogant, self-serving, and ignorant public servants and they should all be kicked off the board for allowing a charge against a storeowner that they had every reason to know was false to proceed. They showed they have no ethics and no conscience. Kick them all off the Board and start fresh. and write to the Mayor to tell her what you think.

Bill's letter was a good one... he does have an ulterior motive though.. he likes those menthol cigs. But his point is well taken, the new BOH is running like the old Hugo BOH.
