It’s been 11 years since Eurie Stamps was killed

It was 1 year ago when Middlesex District Attorney Marian Ryan said her office has asked the FBI to assist in its review of the incident and its aftermath.

“We realized we had a need for professional forensic help,” she told the Daily News in an interview last week.

The DA’s Office contacted the FBI to see if it would assist in the review. It has sent the FBI all documents related to the case that it possessed.

Meanwhile, the Massachusetts State Police has gone to Stamps' former home and taken new measurements and photographs that have since been sent to the FBI, Ryan said.

“The questions have continued to be raised by Mr. Stamps’ family and the community,” said Ryan. “I think it’s important to do everything we can do to provide answers, if possible, and to be as transparent as possible.”

And it was 1 and a half years ago that #JusticeForEurie succeeded in convincing Ryan to review the initial investigation. The review began in August and remains ongoing.

As part of our commitment to making records associated with this Office’s investigation into the January 5, 2011, shooting death of Eurie Stamps Sr. available to the public, our office has identified records that were previously released to public records requestors following the conclusion of the Middlesex District

The DA’s office has done a great service to our community by making all the documents regarding Mr. Stamps death available for everyone to see here:

It is revealing to hear and read the interviews of those SWAT team members who crashed Mr. Stamps home. And even more revealing are the reports from ballistic experts and the forensic experts on how Mr. Stamps was killed. One said Duncan had to be standing when he shot Mr. Stamps, another refuted that opinion.

As everyone may recall, Marion Ryan last year or so said she asked the FBI to look into the case. Somehow the State cops were involved as well. I’m curious to see what their findings were.

I filed a FOIA with the DA’s office this week.

Thank you for staying on this Jim. I would have thought the FBI would have finished by now but justice is a slow process I guess. Stay on this and please share what you learn

Isn’t it long past time to let this go?

As long as the facts is this case are still in question, I'd say no, it's not time.

Not that the FBI investigation will turn up a smoking gun, but there's still a question of how Mr. Stamps was killed. There is no limitation on holding any police officer accountable for killing an innocent man.

And lets not forget, the 26 year female police officer who pulled her side arm instead of her tazzer and killed a man in his car while he tried to drive away over a traffic stop.
The moral of that story was, accidents can be criminal and she was convicted of killing the man, by accident.

Interesting. George Floyd is murdered and the residents of his community speak loudly and in public and justice is served. Here in the Ham we say let’s continue to ignore the murder of an innocent man in his home. What does that say about us?

What happens if the investigation by the FBI finds the officer responsible? Would he actually go on trial? Leone should face charges if that happens for failing to do anything. Just like the DA in the Aubrey case is facing

Good point about accidents being criminal. No one believes the officer shot Mr. Stamps intentionally. But in a fair and just society the taking of a life must have consequences

My impression about the requests the DA made of the FBI is that they (FBI) have ballistic experts that can reassemble the crime scene and verify or not whether Duncan was standing or falling down when he pulled the trigger.
It’s very clear to me after ready Downing’s interview that FPD had made the decision that the house was a drug den with lots of activity before they crashed in. That was and still is the drug war mentality of our police force.
From there I don't know. My guess is that the DA, AG or the Justice department would investigate the whole matter from the beginning.
I would hope we could all agree, Duncan fired the shot that killed Eurie and that this retired disabled senior citizen had the Constitutional right to live.

What does the family want? They should have some say

11 years and still no justice seems like an awful long wait. But what exactly would justice look like anyway? Nothing brings Mr. Stamps back. But the fact that the officer who took his life faced absolutely no consequences to me is abhorrent. Actions have consequences and to have none for taking someone's life says a lot about our judicial system. What do you think would have happened here if a white man had been shot dead accidently by a black Framingham police officer? I think it would have been a very different outcome. What do you think?

not defending anyone... but the FBI has had their hands full investigating the thousands of insurrectionists who tried to stop our election process. But I agree it's time to show your cards

I agree... it's whole different story with different outcomes if a white man was involved in either situation.

I don't and won't speak for the family, I will only report what has been written by the press. Justice for Eurie wanted Duncan fired and wanted the AG or the Justice Department to have a fresh look at the case.
Marion Ryan decided to honor the wishes of the family and have a look at the case and release everything on file (I assume everything, I have no way of knowing) on her web site for everyone to see. And a promise to release information not previously asked for through FOIA requests.
She has lived up to that part, imo.
Her legal aid has responded in less than a day with questions about my questions.. how do you like that?

What happens if the FBI says the story of what happened does not fit the evidence? Anyone know?
